Can I Sue my ISP for this?
November 30th, 2009 | by admin |My isp is WCN (West Central Network) and i have been with them since August. I unfortunatly signed a contract with them for 1-year of satellite internet. Im paying $30/month for very slow speeds of 256K download and 128K upload. At first all this seemed bareable so i decided i’d sign the contract. but since October My internet has been VERY unstable. At first my internet would only work on the weekends, then it gradually started getting worse, I have been giving my isp phone calls about this at least 3 to 4 times a week!! They tend to solve the problem and bring my internet back up the next day after i call. They refuse to send a technical person to come down and inspect my satellite and equipment and tell me that their radio server was just having a quick delay. This past month It has gotten to its worst peak and my internet barely even works, And when it does work, (like right now) I get horrible speeds of 80K down and 100K up, All This for $30/month. I ask to speak to their manager and they just send me to a technical helper, Who always tells me to do the same thing " Restart your computer and wait 30min"
Giving this company so many phone calls a week for the passed 2months has been giving me headaches, and Since i spend most of my time serfing the net, it has aggrivated me, yet i dont know what to do. I feel powerless because I have simply asked if i can just cancel my service with them but they want to throw a huge $600 fee if I cancel. I have even asked if i can simply switch over to their DSL service (Hoping it will work better) but they refuse and say i cannot. I dont plan on sueing them, but It would be nice to be able to cancel this plan with them.
I can’t find the organization you are talking about, but chances are they have a terms of service that refuses any warranty for their service. If that’s the case, you can sue but you won’t win; they’ve given you what you have bargained for (that is, they have provided you with service, however inadequate or beneath what you expected).

You can’t sue. You signed a contract for a sucky service.
Just wait til your contract ends and get some other service entirely different.

call your better business bureau and see if they can help you. if not see about taking them to small claims court. looks to me like their not living up to their end of the bargin.

you can sue anyone for anything even though it may not hold up in court; you could sue someone for something as silly as staring at you repetitively(even though a judge will say why are you wasting my time or you get laughed out of the courthouse)
(even though half of the time people go to court it’s not worth it, and if they have lawyers only the lawyers win by getting paid.)
